These Terms of Service (“Terms”) govern your use of ronnywilson.com (the “Site”) and any services provided by Kennedy Christian, Inc, doing business as Icon Real Estate Group, and real estate broker Ronny Wilson (“Icon Real Estate Group,” “we,” “us,” or “our”). By using the Site or engaging us for services, you agree to these Terms. If you do not agree, do not use the Site or our services.
1. Services
Icon Real Estate Group provides residential real estate brokerage services, including assisting clients in buying, selling, and investing in real estate, primarily in the greater Puget Sound region. The specific scope of any brokerage engagement is defined in a separately executed agreement (for example, a buyer agency agreement, listing agreement, or purchase and sale agreement) (“Brokerage Agreement”). These Terms apply to general use of the Site, initial inquiries, and newsletter, event, and marketing engagement. Active brokerage engagements are governed by their respective Brokerage Agreements and by applicable Washington real estate law. To the extent any Brokerage Agreement conflicts with these Terms, the Brokerage Agreement controls.
2. Real Estate Licensing and Brokerage Relationships
Ronny Wilson is a licensed real estate broker in the State of Washington. Real estate brokerage relationships, agency duties, and disclosures are governed by Washington real estate law and are established through the applicable Brokerage Agreement and required agency disclosures, not through general use of the Site. Using the Site or submitting an inquiry does not, by itself, create an agency or brokerage relationship. We are committed to compliance with the federal Fair Housing Act and Washington fair housing laws and do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected class.
3. Listings and Property Information
Property listings, prices, availability, and related data displayed on the Site are provided for general informational purposes, may originate from third-party multiple listing services (MLS) or IDX feeds, and may not be current or complete. Listing information is deemed reliable but is not guaranteed. You should independently verify any information important to a purchase or sale decision. Nothing on the Site is an offer to buy or sell real estate.
4. Payment Terms
Brokerage compensation (commissions and fees) is governed by the applicable Brokerage Agreement and disclosed in advance as required by law. Any fees collected through the Site or our payment processor are governed by the terms disclosed at the time of the transaction.
5. Intellectual Property
The Site, including all text, design, graphics, logos, photography, and code, is the property of Icon Real Estate Group or its licensors and protected by U.S. copyright and trademark law. The “Icon Real Estate Group” and “Ronny Wilson” names and related logos are trademarks of their owner. Listing photographs, MLS data, and content authored by third parties remain subject to those parties’ separate licenses and copyrights. Content you provide to us (photographs of your property, preferences, documents) remains your property or the property of its original author, and you represent that you have the right to share any materials you provide.
6. Acceptable Use of the Site
You agree not to use the Site for unlawful purposes; attempt to access non-public areas of the Site, our servers, or our service providers; reverse engineer, copy, or replicate the Site’s design, code, listing data, or content for commercial use; scrape or harvest listing data or contact information at scale; interfere with the Site’s operation; or submit false or misleading information through forms. We reserve the right to block or terminate Site access for violations.
7. Third-Party Services and Transaction Partners
We coordinate with third-party professionals and platforms to deliver services, including cooperating brokers, MLS providers, lenders, title and escrow companies, inspectors, appraisers, and software platforms (IDX Broker, GoHighLevel, Google, and others). We are not responsible for acts or omissions of independent third-party professionals operating under their own contracts and licenses; outages, errors, or limitations of third-party software platforms or IDX/MLS data feeds; or delays caused by lenders, escrow, inspectors, appraisers, or other third parties.
8. Warranties and Disclaimers
The Site, including listings, property searches, and informational content, is provided “as-is” without warranties of any kind, express or implied. Property information is deemed reliable but not guaranteed. Estimated values, timelines, and outcomes communicated during pre-engagement are good-faith estimates; final commitments are made only in executed Brokerage Agreements.
9. Limitation of Liability
To the maximum extent permitted by law, our total cumulative liability arising out of or related to these Terms or general Site use shall not exceed the greater of (a) the amount paid by you to us outside of an active Brokerage Agreement, or (b) $1,500. We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages. Transaction-specific liability is governed by the applicable Brokerage Agreement and Washington real estate law, which take precedence over this section for matters arising from brokerage services.
10. Indemnification
You agree to indemnify and hold harmless Icon Real Estate Group, Kennedy Christian, Inc, and Ronny Wilson, and their officers, employees, and independent contractors from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your violation of any law or third-party right, content or materials you provide that infringe a third party’s rights, or your misuse of the Site.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or general Site use (separate from disputes governed by an active Brokerage Agreement) shall be resolved first through good-faith negotiation for at least 30 days; then through non-binding mediation in King County, Washington; and, if mediation fails, exclusively in the state or federal courts located in King County, Washington, to whose jurisdiction both parties consent. Brokerage Agreement disputes are governed by the dispute-resolution provisions in the applicable Brokerage Agreement.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via a prominent notice on the Site and an updated “Last Updated” date at the top of these Terms. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
13. Miscellaneous
These Terms, together with any Brokerage Agreement and the Privacy Policy, constitute the entire agreement between you and us concerning the subject matter. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not waive our right to do so later. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond reasonable control.
